These Terms govern your access to and use of the CallBuiltt website, platform, software tools, content, communications, and related services.

1. Acceptance of These Terms
These Terms and Conditions (the “Terms”) govern your access to and use of the CallBuiltt website, platform, software tools, content, communications, and related services (collectively, the “Services”) provided by CallBuiltt (“Company,” “we,” “us,” or “our”). By accessing, purchasing, registering for, or using the Services, you agree to be bound by these Terms.

If you are using the Services on behalf of a business or other organization, you represent that you have authority to bind that organization to these Terms. If you do not agree to these Terms, do not use the Services.

2. Who the Services Are For
CallBuiltt is intended for business use by owners, operators, and authorized representatives of small businesses and organizations. You must provide accurate information, keep your account credentials secure, and promptly update your information if it changes.

You are responsible for all activity that occurs under your account, whether or not authorized by you, unless caused directly by our gross negligence or willful misconduct.

3. Description of the Services
CallBuiltt may include website tools, CRM functionality, lead tracking, calendars, forms, automations, conversation management, business phone features, review workflows, analytics, AI-assisted tools, and related integrations. Specific features may change from time to time.

Some portions of the Services may be powered by or integrated with third-party providers, including payment processors, telecommunications carriers, messaging providers, hosting providers, calendar providers, AI vendors, and software infrastructure partners. Certain features may be subject to additional third-party terms.

4. Subscriptions, Fees, and Billing
If you purchase a subscription or paid service, you agree to pay all applicable fees, taxes, setup charges, usage-based charges, and add-on fees disclosed at the time of purchase or in your order form. Unless otherwise stated in writing, subscriptions renew automatically for successive billing periods until canceled.

You authorize us and our payment processors to charge your selected payment method for recurring subscription fees and any other amounts due. If a payment cannot be collected, we may suspend or terminate access to the Services.

Unless your order form or a separate written policy states otherwise, fees are non-refundable and unused portions of subscriptions are not prorated.

5. Free Trials, Promotions, and Beta Features
We may offer free trials, limited promotions, discounts, or beta features from time to time. We may change, end, or revoke these offers at any time unless prohibited by law.

Beta or early-access features are provided “as is” and may be modified, interrupted, or discontinued without notice.

6. Customer Responsibilities and Compliance
You are responsible for how you use the Services, the content you upload, the contacts you import, the campaigns you send, and the permissions you obtain from your leads, customers, and users.

You agree to comply with all applicable laws, regulations, industry rules, carrier requirements, and platform rules relating to your use of the Services, including laws governing privacy, advertising, telemarketing, call recording, email marketing, text messaging, and consumer protection.

Obtain any required consent before sending marketing emails, text messages, ringless voicemails, or automated communications.
Honor unsubscribe, opt-out, STOP, do-not-call, and similar requests promptly.
Do not upload or use purchased, scraped, rented, or unlawfully obtained contact lists.
Do not use the Services to transmit spam, phishing attempts, malware, deceptive content, or unlawful offers.

7. SMS, Calling, and Email Communications
If you provide a mobile number or otherwise opt in to communications from CallBuiltt, you agree that we may send you service-related messages, appointment reminders, account notifications, support updates, and, where permitted by law and your consent, promotional messages. Message frequency may vary. Message and data rates may apply.

You can opt out of marketing text messages at any time by replying STOP to a text message you receive from us. You may reply HELP for assistance where supported. Opting out of marketing texts does not prevent us from sending non-marketing service or transactional messages when permitted by law.

For email marketing, you may unsubscribe using the link included in those communications. You remain responsible for making sure your own use of CallBuiltt’s communication tools complies with applicable email and text messaging rules.

8. Acceptable Use Restrictions
You may not misuse the Services or assist others in doing so.

Reverse engineer, copy, resell, frame, mirror, or exploit the Services except as expressly permitted by us in writing.
Interfere with platform security, performance, or availability.
Use the Services for unlawful, fraudulent, abusive, harassing, defamatory, or discriminatory activity.
Send content that infringes intellectual property rights or violates the rights of others.
Use the Services in a manner that could cause us, our vendors, or our users to violate laws, carrier rules, or third-party platform requirements.

9. Customer Content and License
You retain ownership of the text, images, logos, contact data, recordings, templates, campaigns, and other materials you submit to or create through the Services (“Customer Content”). You grant us a non-exclusive, worldwide, limited license to host, copy, transmit, process, display, and use Customer Content solely as needed to provide, maintain, secure, improve, and support the Services.

You represent and warrant that you own or have the necessary rights, permissions, and legal basis to use Customer Content and to allow us to process it on your behalf.

10. Intellectual Property
The Services, including the CallBuiltt name, branding, software, website copy, design elements, workflows, graphics, and underlying technology, are owned by the Company or its licensors and are protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, no rights are transferred to you.

11. Third-Party Services and Integrations
The Services may contain links to or integrations with third-party products, websites, software, telecom services, payment processors, and other services that we do not control. Your use of third-party services is governed by the terms and privacy practices of those providers.

We are not responsible for third-party outages, pricing changes, policy changes, data handling, or service performance, even if those third-party services are integrated with CallBuiltt.

12. Service Availability and No Guaranteed Results
We aim to provide reliable Services, but we do not guarantee uninterrupted availability, error-free operation, message delivery, lead volume, conversion rates, search rankings, revenue outcomes, or any particular business result.

Delays or failures may occur because of internet outages, carrier filtering, third-party platform restrictions, software bugs, maintenance, security events, or causes outside our reasonable control.

13. Suspension and Termination
We may suspend or terminate your access to the Services immediately if you violate these Terms, fail to pay amounts due, create legal or reputational risk, or use the Services in a way that threatens platform integrity or other users.

You may cancel your subscription in accordance with your plan terms or order form. Termination does not relieve you of payment obligations that accrued before the effective termination date.

14. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITIES, OR BUSINESS INTERRUPTION ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO US FOR THE SERVICES DURING THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS (US $100), WHICHEVER IS GREATER.

16. Indemnification
You agree to defend, indemnify, and hold harmless the Company and its affiliates, owners, officers, employees, contractors, licensors, and service providers from and against claims, liabilities, damages, judgments, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your Customer Content, your breach of these Terms, or your violation of any law or third-party right.

17. Governing Law and Disputes
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Services will be resolved in the state or federal courts located in Colorado, unless a separate written agreement provides otherwise.

18. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we may post the updated version on our website, update the “Last Updated” date, or provide additional notice when required by law. Your continued use of the Services after the effective date of updated Terms constitutes acceptance of the revised Terms.
